As part of our commitment to our customers, this comprehensive Privacy Policy ("Policy") has been adopted by Cincinnati Bell Inc., now doing business as altafiber, and its subsidiary and affiliated entities including Cincinnati Bell Telephone Company LLC dba altafiber Network Solutions and Cincinnati Bell Extended Territories LLC dba altafiber connected services (collectively, “altafiber”, “we, and “us”). We respect your privacy and are committed to protecting it through our compliance with this Policy. This Privacy Policy applies to your personal information we collect when you (i) visit any Website that we own, license, or otherwise operate and that links to this Policy (each, a “Website”), (ii) download, install, register with, access, or use our mobile applications or other online service that links to this Policy (each an “App”), (iii) purchase or receive products or services through the Website or App, or (iv) visit our offices or otherwise contact or engage with us.

 

This Policy, together with the Website Terms of Use posted on our Website, sets forth the general rules, policies and procedures which govern your use of our Website and App and our policies and practices for collecting, using, maintaining, protecting and disclosing personal information you provide or which is collected in relation to your use of the Website or App. Depending on your activities when visiting our Website or App, you may be required to agree to additional terms and conditions. Further, other products and services we offer such as Fioptics Broadband Internet Service or Fioptics+ Video Service may have their own privacy policies. In the event of a conflict between this Privacy Policy and a product-specific privacy policy, the product-specific privacy policy will control.

We keep this Policy posted on our Website and you should review it frequently, as it may change from time to time without notice. Information We Collect

 

We collect personal information about you from a variety of sources, including:

  • Information you provide to us directly when you purchase our products or services, such as name, address, phone number, and credit card number
  • Information we collect about you when you visit our Website, an App, use our services, or view our online advertisements, such as IP address, search terms, and pages or content you visit while on our Website or App
  • Information we collect about you from other sources, such as commercially available sources
  • Information supplied by you to our Website or App, such as demographic information (e.g., age, gender, purchase preference, etc.).

During the course of business, we may ask you to provide directly to us personal information such as your name, home address, telephone numbers, e-mail address, credit card number, social security number, birth date. Although we generally collect personal information directly from you, on occasion, we also collect certain categories of personal information about you from other sources. In particular: (a) financial and/or transaction details from payment providers located in the US and other regions in order to process a transaction; (b) third party service providers (like Google, Facebook, LinkedIn) who are located in the US or other regions, which may provide information about you when you link, connect, or login to your account with the third party provider and they send us information such as your registration and profile from that service. The information varies and is controlled by that service provider or as authorized by you via your privacy settings at that service provider; and (c) other third party sources and/or partners from US or other regions,  whereby we receive information about you (to the extent permitted by applicable law), such as demographic data or contact information. We also receive information about your experiences and interactions from our partner ad networks. Information we collect about you may be combined to help us tailor our services to you and other customers.

 

You are permitted, and hereby agree, to only provide personal information to Company if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure will not violate any applicable data protection law, statute, or regulation or infringe upon a person’s data privacy rights or privileges. IF YOU PROVIDE PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO COMPANY, YOU EXPRESSLY REPRESENT AND WARRANT TO COMPANY THAT YOU HAVE THE FULL RIGHT AND AUTHORITY TO PROVIDE COMPANY WITH SUCH PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) AND THAT COMPANY’S USE AND PROCESSING OF SUCH PERSONAL INFORMATION AS SET FORTH HEREIN WILL NOT VIOLATE ANY PERSON’S RIGHTS OR PRIVILEGES, INCLUDING RIGHTS TO PRIVACY. YOU HEREBY AGREE TO FULLY AND COMPLETELY INDEMNIFY COMPANY FOR ANY CLAIMS, HARM, OR DAMAGES THAT MAY ARISE FROM YOUR PROVISION OF PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO COMPANY. You are prohibited from providing us with “consumer health data” or similar health information.

 

In certain circumstances, we may request, allow or otherwise provide you an opportunity to submit your personal information in connection with a feature, program, promotion or some other aspect of our Website or App. For instance, you may: (a) provide your name, mail/shipping address, email address, credit card number and phone number when registering with our Website or App, or purchasing or using our services; (b) provide certain demographic information about yourself (e.g., age, gender, purchase preference, usage frequency, etc.) when participating in a survey or poll; or (c) post a general comment and/or recommendation on our Website or App.

 

Updating Your Personal Information

 

It is important that the personal information that you provide to us is accurate and reliable. If you are an existing customer, you may have the ability to directly update and change certain of your personal information (e.g., name, telephone number, email, shipping address) via My altafiber Account, and you must do so when such changes are warranted. If you cannot access your MyAccount to mark necessary updates, you may call Customer Care to request relevant updates.

 

How We Use Your Information

 

We may use your personal information to provide the products and services you request, to tell you about our other services, and to manage our Website, App, and services.  We may share your basic personal information with one or several of our business partners to make initial determination of the services you may need.  We may also share your information to protect and defend the rights and property of altafiber.

 

We use your personal information for the following business purposes:

  • To ensure that you are receiving the products and services you ordered
  • To allow us to properly maintain and communicate with you about those products and services and to make improvements or upgrades when necessary
  • To confirm that you are being properly billed
  • To provide you with technical support and for system maintenance
  • To inform you of new products or services that may be of interest to you
  • To allow us to understand the use of, and identify improvements to, our services
  • To prevent fraud, including the unauthorized use of our services or violations of applicable policies and terms of service
  • To ensure our compliance with the law
  • To respond to legal requests or as otherwise required by applicable law

Additionally, we may use or disclose personal information about you without your consent to protect our customers, employees, or property in emergency situations or to enforce our rights under our terms of service and policies in court or elsewhere.  Further, we may disclose your personal information where necessary to provide or conduct a legitimate business activity related to the services provided to you, or as required as required by law or legal process, as more fully discussed under Other Uses and Information below.

 

How We Share/Disclose Your Information

 

We may share your personal information with certain organizations and third parties in accordance with applicable law, including as set out below. However, we do not share, sell, rent, or otherwise transfer your personal information, including SMS/text consent, with third parties, for their own direct marketing purposes.

  • Intra-Group Transfers. We may share this information within the family of altafiber-affiliated companies to improve our services to you.
  • Service Providers/Partners: We may share your personal information with our service providers, agents, and trusted business partners only when required for the specific and limited purpose of providing products or services to you that you have authorized, such as to our shipper in order to fulfill an on-line order, or in the context of one of our mobile applications (e.g., My altafiber or Fioptics+), to a content provider to increase the relevance of the content you are served.
  • Transfer of Assets:  As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all (or substantially all) of our assets, information we have about you, including personal information, will be transferred to and used by the acquiring entity, though we will take reasonable steps to ensure that your preferences are followed. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be disclosed or transferred to third parties.
  • Legal; Compliance:  We reserve the right to disclose personal information if we are required to do so by law, with respect to copyright and other intellectual property infringement claims, or if we believe that such action is necessary to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our, or other users; or (d) in an emergency to protect the health and safety of our customers or the general public.
  • Marketing and Advertising Partners: We disclose personal information to marketing and advertising partners who help us provide tailored advertisements, promotions, sweepstakes, contests and campaigns when you are interacting with us on our Website, App, online platforms, social media, or elsewhere.

If you create a personal account or business account, facilitate a transaction  with us or request information from or otherwise engage with us, and such activities require us to share your personal information with a service provider or other third party, you hereby consent to such disclosure and/or direct us to intentionally disclose your personal information to the service provider or third party.

 

Cookies, Technical Data, and Preference-Based Advertising

 

When you access our Website or App, we collect certain data automatically using technical means and tools. This data relates to your device, as well as your experience on our Website, App, and other websites, including the following:

  • Usage and Device Data: When you access and use our Website or App, we automatically collect details of your access to and use of the Website or App, including traffic data, usage logs and other communication data, and the resources that you access and use on or through the Website or App (e.g., browsing history, search history). We may also collect information about your device and internet connection, including the device’s unique identifier (e.g., device type, IMEI, Wi-Fi MAC, IP address), operating system, browser type, and mobile network information. Our Website or App may collect “diagnostic” data related to your use of the Website, such as crash data and logs, performance data (e.g., launch time, hang rate, or energy use), and any other data collected for the purposes of measuring technical diagnostics.
  • Cookies and Tracking Data; Social Media: We use “cookies” and other tracking technologies within our Website and App. A cookie is a small file placed on your computer, smartphone or other device. It may be possible to refuse to accept cookies by activating the appropriate setting on your computer, smartphone or device. However, if you select this setting, some parts of the Website or App may become inaccessible or not function properly. In addition, the Website or App may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to analyze data on your use of the Website or App (e.g., recording the popularity of certain content and verifying system and server integrity). The Website or App may collect and share data about the search terms you entered in a search bar on our Website or App or advertisements you have seen or engaged with to third parties.  From time to time, we may use certain third-party cookies and pixels provided by our marketing partners, including social media companies on our Website or App. To the extent we use such third-party cookies and pixels, you hereby agree to the terms and conditions set forth by those third parties, which may include Meta, X (formerly Twitter), TikTok, and LinkedIn, among others.
  • Monitoring: Please be aware that we, and our service providers and partners, use cookies and other tracking technologies within the Website and App to monitor and record any and all activities and communications to, from, and on, the Website and App. For the avoidance of doubt, you hereby acknowledge, agree, and consent to, such monitoring and recording by us and our service providers and partners.
  • Non-Cookie Technologies: We may deploy certain types of “Non-Cookie Technologies” provided by our service providers to support our digital advertising programs on our Website and App. These technologies often include browser cache, locally stored objects, or the creation of a statistical identifier wherein an identifier, much like a cookie identifier, is calculated based on the characteristics of a browser or device that distinguishes it from other browsers or devices. These identifiers are calculated either from the data your browser or device shares automatically or with additional data specifically requested from your browser or device.   • Preference-Based Advertising: We may work with third parties, including third party advertising networks and Website analysis firms who use cookies and web beacons   to serve you with personalized or interest-based advertisements or other messages while you are on our Website and/or on third party sites that better reflect your preferences and needs.  For more information on how preferential advertising works, go to NAI Self Regulatory Program.

    If you do not wish to participate in this preference-based advertising via these third party advertising networks, go to NAI Opt Out and follow the simple opt-out process. A couple of important notes about this opt-out tool: (1) it includes all the advertising networks that we may work with, but also many that we do not work with; and (2) it may rely on cookies to ensure that a given advertising network does not collect information about you (“Opt-out Cookies”). Therefore, if you use or buy new computer, change web browsers or delete these Opt-out Cookies from your computer, you will need to perform the opt-out task again.   • Do Not Track Features: Some web browsers may transmit “do-not-track” signals to the Website or App with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they are even aware of them. Unless otherwise required by law, we currently do not take action in response to these signals.

 

Email Communications  

 

In certain instances, we may communicate with you via email. For example, you may receive email communications if you provide your email address in relation to an inquiry about service availability, if you request a particular service or sign up for a feature that involves email communications, if you make a purchase and provide you email address as a means of communication, provide your email address as part of a sweepstakes or promotion registration, or you consent to being contacted by email for a particular purpose. You may “opt out” of receiving future commercial email communications from us by clicking the “unsubscribe” link included at the bottom of emails we send. Alternatively, if you are an existing customer, you can change your email communications preferences via the Notification section of My altafiber Account at any time; provided, however, we reserve the right to send you transactional emails such as customer service communications.

 

SMS/Text messages Communications

 

If you provide your mobile telephone number as part of your account set-up, you will automatically be enrolled to receive automated SMS/text messages for account, billing, payment and outage updates (“Informational Messages”). You can change your SMS/text message communications preferences, including the types of account-level messages you receive, via the Notification section of MyAccount at any time.  With your permission (i.e., if you opt-in), we may also send automated marketing text messages to tell you about our products and services (“Marketing Messages”). Please review our Mobile Messaging Terms & Conditions for more information, including information on how to unsubscribe or update your text messaging preferences and your responsibilities and liabilities related thereto. We will not share, sell, or transfer your opt-in consent to receive SMS/text messages for marketing purposes with any third party.

 

For the avoidance of doubt, you hereby agree that we may contact you via any means, including via SMS/text message and email and through the use of autodialing systems and services, to furnish you information regarding order updates, appointment reminders, and similar data and information pertaining to a commercial transaction, provided however, the foregoing is not, and shall not be interpreted as, an admission that we use an autodialing system.

 

Mobile Apps Access and Use

 

As noted above, this Privacy Policy applies to our Apps which may link to this Privacy Policy. During your access to and use of any altafiber mobile application, we may collect personal information including your first and last names, email addresses, online identifiers, and other personal information used to register with, download, or access the relevant mobile application. We may also collect information about your use of the App, including usage patterns and feature interactions, to improve App functionality and user experience. We may de-identify and aggregate this data in order to develop more effective and efficient products and services.

 

Opt-out of information collection by uninstalling an App. You can stop collection of personal information by a specific App by uninstalling that App. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. Please note that uninstalling an App only stops data collection through that particular App. If you use other altafiber services (such as our wi-fi services), you should review your privacy settings for each service separately. To request deletion of personal information previously collected through an App, please see applicable “Privacy Rights" sections below.

 

Use by an App of Location Information. Certain Apps may request access to your device's location information to provide location-based features such as service availability in your area or locating nearby service centers. We will obtain your consent before collecting precise location information, including collection while the App runs in the background. Background location collection, when enabled, allows the App to provide location-relevant notifications and services even when you are not actively using the App. You may enable or disable location services at any time through your device settings menu or within the App. Disabling location services may limit certain location-dependent features, but core App functionality will remain available. Please note that certain third-party service providers integrated into our Apps may independently collect location information subject to their own privacy policies. Additionally, even with location services disabled, we may still derive approximate location information from your IP address or wi-fi network connection for purposes such as fraud prevention and compliance with applicable law.

 

Push Notifications or Alerts. During the initial installation of our App on your device, you may be asked to consent to receive "push notifications" or "alerts" from the App. These notifications may include service updates, promotional offers, or other information related to your use of the App. You can enable or disable these messages at any time by changing the notification settings on your mobile device or within the App. Disabling push notifications will not affect your ability to use the App. 

 

How We Protect Customer Privacy

 

We take the security of your personal information very seriously.  We have implemented industry-standard security measures to protect against the loss, unauthorized access, misuse and alteration of the information under our control by persons inside and outside of altafiber, including firewalls and Secure Socket Layer (SSL) encryption. To help ensure the confidentiality of your personal information, it is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer.

 

Please be advised, however, that while we strive to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and are not responsible for the theft, destruction, or inadvertent disclosure of your personal information. In the unfortunate event that your personal information (as the term or similar terms are defined by any applicable law requiring notice upon a security breach) is compromised, we may notify you by e-mail (at our sole and absolute discretion unless not permitted by applicable law) to the last e-mail address you have provided us in the most expedient time reasonable under the circumstances; provided, however, delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation. From time to time, we evaluate new technology for protecting information, and when appropriate, we upgrade our information security systems.

 

Linked Web Sites

 

The Website and App may contain links to various other websites that we do not control or maintain. Please be aware that these other websites may have privacy policies that may differ from altafiber's policies. altafiber assumes no responsibility for either the content that appears on linked Websites or the privacy of the information you provide once you have linked to other Websites. You should read the privacy policies of all third-party Websites before submitting any personally identifiable information.

 

We may include videos and similar media players on our Website or App. By clicking on such videos and similar media players on our Website or App (i) you may be redirected to a third party’s Website to play the video, or (2) it may play the video on our Website or App with functionality supported by a third party’s website or technology (e.g., YouTube, YouTube API, Vimeo). In any such case, by playing the videos or similar media players, you shall become subject to the third party’s terms and conditions, including, but not limited to, its terms of service and personal information privacy policies and practices, including the terms governing YouTube and Vimeo.

 

Data Retention and Localization

 

The period during which we retain your personal information varies depending on the purpose for the data processing. For example, we retain personal information for as long as needed to provide you with our Services, to facilitate transactions you have requested, to comply with our legal obligations (e.g., tax filings, export control laws), to engage in marketing activities, and for as long as is necessary to defend our legal or business interests. In all other cases, we retain your personal information for as long as is needed to fulfill the purposes outlined in this Privacy Policy.

 

Company is based in the United States, and the personal information that we collect and process is retained and stored in the United States. However, your personal information may be accessed by our vendors or service providers located outside of the United States. Company does not participate in the U.S. Data Protection Framework.

Customer Proprietary Network Information (CPNI)

 

The Telecommunications Act and federal regulations give you, the customer, a choice about how altafiber uses information about your current telecommunications services to provide information to you about new or additional products and services that will best meet your communication needs. These regulations are designed to protect your privacy rights as a telecommunications customer. altafiber values our customers’ privacy and meeting your communication needs is our top priority. Under federal law, altafiber must obtain your permission to use your Customer Proprietary Network Information (CPNI) to market new or additional products or services to you and to share this information with our affiliates and authorized sales representatives. CPNI is data that is not publicly available and includes information such as type of service, number of telephone lines, amount of usage, and calling and billing records. Public Forums

 

We may offer chat rooms, blogs, message boards, bulletin boards, or similar public forums where you and other users of our Website or App can communicate. The protections described in this Policy do not apply when you provide information (including personal information) in connection with your use of these public forums. We may use personal information about you to identify you with a posting in a public forum. Any information you share in a public forum is public information and may be seen or collected by anyone, including third parties that do not adhere to our Policy. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through our Website.

 

Children Under 16

 

Our Website and App is not intended for children under 16 years of age. No one under the age 16 may provide any personal information to us by using the Website or App. We do not knowingly collect personal information from children under the age of 16.   • Right to Delete. You have the right to request that we delete your personal information that we have collected and retain.
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we have collected and retain.
  • Nondiscrimination. You have the right not to be subject to discrimination for asserting your rights under the CCPA.

Submit a Privacy Request. To submit a privacy request, you (or your authorized agent) may contact us in accordance with the “Contact Information” section listed below. However, any such authorized agent must be registered with the California Secretary of State to conduct business in California.

 

Privacy Request Verification Process. If you (or your authorized agent) make any request related to your personal information, we will ascertain your identity (and the identity of the authorized agent, to the extent applicable) to the degree of certainty required or permitted under the law before addressing your request. In particular, we will, to the extent required or permitted by law, require you (or your authorized agent) to verify your request via email, request certain contact information or government identifiers, and we will match at least two pieces of such personal information with data that we have previously collected from you before granting you access to, erasing, or correcting, specific pieces or categories of personal information, or otherwise responding to your request. We may require written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the requests set forth herein, unless you have provided the authorized agent with power of attorney pursuant to California Probate Code §§ 4121 to 4130. None of the CCPA’s rights are absolute, and such rights are subject to legal and regulatory exceptions and exemptions. Opt-Out Rights / Do Not Sell My Personal Information. California residents have the right to opt out of the “sale” of their personal information. However, we do not sell your personal information to third parties for profit or monetary or other valuable consideration, and therefore we do not provide opt-out request processes for the sale of personal information (because we do not undertake such activities).

 

Opt-Out Rights / Do Not Share My Personal Information. California residents have the right to opt out of the “sharing” of their personal information. We uses third-party analytical and targeted advertising features on our Site and similar web tools provided by our marketing partners, and such features, tools and marketing relationships involve the disclosure of your personal information to third parties and may constitute the “sharing” of your personal information for CCPA purposes. To opt out of this sharing of your personal information in these circumstances, please click on the cookie management tool (sometimes visible as a “Your Privacy Choices” or a “Do Not Sell/Share My Personal Information” link on the footer of the Site) to set your cookie preferences. Children. The Site is not directed at, and should not be used by, minors under the age of sixteen (16), and therefore we do not knowingly sell or share the personal information of minors under sixteen (16) years of age.

Submit a Privacy Request. To submit these abovementioned privacy requests, please contact us in accordance with the “Contact Information” section below. Where permitted by U.S. state law, you may designate an authorized agent to submit a privacy request on your behalf.

 

Privacy Request Verification Process. If you make any request related to your personal information, the We will ascertain your identity (and the identity of the authorized agent, to the extent applicable) to the degree of certainty required or permitted under the law before addressing your request. Opt-Out Rights / The Sale of Personal Information. You may have the right to opt out of the “sale” of their personal information. However, we do not sell your personal information to third parties for monetary consideration or other valuable consideration, and therefore we do not provide opt-out request processes for the sale of personal information (because we do not undertake such activities). 

 

Opt-Out Rights / Targeted Advertising. You may have the right to opt out of having their personal information used for targeted advertising purposes. We use third-party analytical and targeted advertising features on our Website and similar web tools provided by our marketing partners.
